Just when we all thought it was safe to blow out the sprinklers for the year it may hit 70 this week, 7 days after we get a foot and a half of snow. Fall in Colorado - go figure.

Thankfully for my kids, the big storm didn't hit on Halloween. How could my two boys have possibly survived without the 12 pounds of candy they got trick or treating (seriously, I saw them weigh it). They are both really good about making it last and will probably have nice candy stashes through the end of the year. I was reminded this past weekend of a Halloween years ago when I was the same age as my youngest by a friend who I have not talked to in at least 25 years. Without going into the specifics lets just say I got violently ill many blocks from home, the walk (run) home was a challenge. Where else would this friend of mine have found me but on Facebook. I try not to burn a lot of time on Facebook because it's so easy to do, I know I'm not the only one out there poking around during the business day because several of you CRA members have "friended" me - thanks for all the "happy birthdays" last month. I really see this social network stuff becoming a business tool although I haven't figured out exactly how it will fit into the roofing business. I have friended some long time customers and it is interesting dynamic, I guess we'll see where social networking stuff goes down the road.

As you begin to put wraps on your year, remember to get those Job of the Year submissions put together. Every job, no matter how basic and simple it may appear has things that make it unique. Remember that most of the judges are not roofers and may be impressed by things that seem routine to you as the professional roofing contractor. The Awards Dinner is a celebration of our industry and every contractor should be proud of what they accomplished during the year. Show off what you did to those who can really appreciate it. Be thinking as well for nominees for the Lifetime Achievement Award for service and commitment to our industry. Nomination forms for both are now available so don't delay - a perfect project for that next snow storm which will no doubt be here shortly.

CRA Awards Dinner- Call for Entries

CRA has announced a call for entries for both Job of the Year and Lifetime Achievement Awards.

Job of the Year Awards are given to roofing contractors in recognition of their outstanding work. Awards are given in four categories based on size of contract. Nominated projects must have been worked on and completed in 2009.

The Lifetime Achievement Award is given to an individual in the roofing industry whose contributions have impacted our industry in a positive way. A Lifetime nominee should be an individual who has contributed to the success, development and continuation of the Colorado Roofing Industry. You may nominate anyone who is currently working in the industry, retired from the industry, or is deceased.

All entries must be received by Dec. 4 and judging will be conducted by a panel of roofing industry experts selected by CRA.

Let's continue to "raise the bar" in the roofing industry. The Awards Dinner gives those of us in the industry time to stop and congratulate ourselves and each other on the difficult, complex, dangerous and exciting work we do every day. October 30 Membership Luncheon Recap

Our October 30 luncheon featuring Todd Zentner a Compliance Assistance Specialist for the OSHA Denver area office was well received. Over 65 CRA members were in attendance for an overview of OSHA's inspection process and procedures, the multi-employer worksite policy, new and proposed rules and local inspection statistics.

Normally when OSHA comes up for discussion, things tend to get pretty "tense," but Todd was knowledgeable and gave a great presentation with just enough humor to keep things "light." Here are a few statistics worth noting from his presentation. These are for the close of Colorado OSHA's 2009 Fiscal Year (FY09 = Sep08-Oct09):

  • Englewood Office (covers southern half of state) completed 740 inspections of which 3 were fatalities.
  • The Denver area office completed 660 inspections with 7 of those fatality investigations.
  • Overall, fatalities were down from FY08 by 65%, which can be attributed to the recession and specifically decreased oil and gas activity in Colorado.
  • Total ROOF inspections for FY08 in all of Colorado were 145 - in FY09 and part of FY10 there have been a total of 288 inspections so far . . . a sure indication that enforcement by OSHA is on the rise.

Changes . . . look for more enforcement. The Denver office is once again fully staffed and with more compliance personnel. Other changes to expect from the new OSHA administration include increased penalties (much larger fines) and new rules for cranes, combustible dust, and ergonomics. The record keeping emphasis program is looking at companies with low record numbers in high hazard areas! The new administration also wants to see changes made that will give employee's a larger voice.

Residential Fall Protection

A member at the lunch requested the following document be shared with the membership regarding alternative fall protection measures for residential construction. Todd Zentner provided the following link to OSHA STD 03-00-001 that covers the alternatives available to residential roofing contractors.

Please note that the standard states: "Restriction on Application for Roofing Work. The alternative procedures in this Instruction may only be used for this work where: (a) the roof slope is 8 in 12 or less, and (b) the fall distance, measured from the eave to the ground level, is 25 feet or less."

Discovery Channel "How it's Made" features MonierLifetile.

What do surfboards, stickers, sandwich cookies and concrete roof tiles have in common? They will all be featured on the November 6th episode of the Discovery (Science) Channel's How It's Made! Turn your TV dials (or better yet, program your TIVO or DVR) to the Discovery (Science) Channel on November 6th at 9:00 p.m. (ET), to watch how MonierLifetile's concrete roof tile products are made on How it's Made! The filming took place earlier in the year at MonierLifetile's Stockton, CA plant and it will finally air this month. There will also be many "re-runs" of the episode so if you don't catch it the first time, there will be other opportunities.

The Western Roofing Expo 2010 announces 2010 dates. The EXPO will be held once again at the Paris-Las Vegas Hotel & Casino in Las Vegas, Nevada from June 20-23, 2010.

At this webinar, you can hear the experience of Boulder County Transportation Engineer Mike Thomas, who oversaw the first project in Colorado to use Recycled Asphalt Shingles (RAS). Another key presenter is Joe Schroer, PE, from the Missouri Department of Transportation. Mr. Schroer developed the MODOT Spec on Recycled Asphalt Shingles, and has overseen many paving projects using RAS. Dan Krivit, author of the Recycling Asphat Shingles: Best Practices Guide, published by the Construction Materials Recycling Assocation.

Texas-based Roofers Cited for Willful Violations in Colorado

Sep 25, 2009 - OSHA's Area Office in Englewood, Colo., has cited two Texas-based companies, United Renovations and ABC Roofing, with penalties of $59,000 and $38,750, respectively, for violations of the Occupational Safety and Health Act related to fall hazards disclosed at an Aurora, Colo., worksite.

The agency's investigation led to one alleged willful and two alleged serious citations against United Renovation, based out of Carrolton, Texas, and one alleged willful, two alleged serious, and one alleged other-than-serious citations against ABC Roofing, based out of Euless, Texas. Both companies were engaged in roofing work at the Aurora worksite.

"Fall hazards are the biggest killers in the construction industry, a fact that shouldn't be lost on any company," said John Healy, OSHA's area director in Englewood. "In the coming weeks, OSHA will be stepping up its enforcement of fall hazards, especially in those areas of the state that experienced significant hail damage this year--areas where we expect to see an influx in roofing work."

For both companies, the alleged willful violations stem from a lack of fall protection for workers performing roof work and failing to use fall protection while workers were being machine lifted to the roof. OSHA issues a willful citation when an employer exhibits plain indifference to or intentional disregard for employee safety and health.

The alleged serious violations against both companies relate to fall hazards associated with the lift used to elevate workers to the roof and accessing the roof with ladders that did not extend 3 feet above the landing. ABC Roofing was further cited for accessing the roof with a ladder made longer by using a bungee cord to attach a second ladder to it and for failing to train workers in the use of ladders. OSHA issues a serious citation when death or serious physical harm is likely to result from a hazard about which an employer knew or should have known.

The other-than-serious violation, issued against ABC Roofing, is for failing to train workers in fall protection. OSHA issues other-than-serious citations when a violation is directly related to safety and health but unlikely to cause death or serious physical harm.

The companies each have 15 business days from receipt of the citations to comply, request an informal conference with OSHA's area director in Englewood, or contest the findings before the independent Occupational Safety and Health Review Commission.

ITEMS TO NOTE . . . FROM ACROSS THE NATION

At last, there are some glimmers of hope on the economic horizon, but NRCA still doesn't see any significant improvement in the overall construction market for perhaps another year.

NRCA is starting to see signs of increased regulatory activity now that the administration's appointees are in place and in control. At the Occupational Safety and Health Administration (OSHA), there will be more funding for enforcement, as well as a push for new ergonomics rules. Congress also is considering legislation that would give OSHA more power, increase fines for violations and provide more protection for whistle-blowers.

NRCA also expects to see more enforcement of wage and hour disputes and discrimination complaints with a broader definition of "disability" under the Americans with Disabilities Act.

NRCA won an important victory in October when the Department of Homeland Security finalized its proposal to rescind the "no-match" rule that was originally issued in 2007. NRCA was instrumental in the effort through their involvement with the Essential Worker Immigration Coalition.

And one measure NRCA does expect to see action on this year is the estate tax. Left alone, the tax would be entirely eliminated in 2010 then revert in 2011 to its pre-2001 level of 55 percent with a small exemption level. Most likely: a permanent rate of about 35 percent with a per-person exemption of about $5 million.

The IRE, which will be held in New Orleans, Feb. 22-24, 2010, is shaping up to be a terrific event. The Opening Session will feature a power panel of contractors who will discuss strategies for finding work in a soft economy-a program that is sure to be of interest. And the trade show will feature about 450 companies-roughly the same number as the 2009 show. Registration is available at www.theroofingexpo.com.

The National Roofing Legal Resource Center (NRLRC) has issued a management alert outlining the advantages and risks associated with using Building Information Modeling (BIM) to lessen the costs associated with a "fragmented" design and construction process. As BIM projects become more common, contractors need to be aware of the liability they may be assuming.

The Dow Chemical Co. announced in October that it will begin selling a new photovoltaic shingle next year with a wider rollout in 2011. The product uses CIGS technology and can be installed in a manner similar to traditional asphalt shingles, according to the company. Dow Chemical plans to market the new product through roofing contractor channels.

One new committee project nearing completion is NRCA's new guide to roof safety design, which contains recommendations for integrating fall protection into new building construction. The document, which will be distributed to the building design and owner communities, should be published in early 2010.

NRCA's Nominating Committee is seeking the names of candidates interested in serving on NRCA's board of directors and Executive Committee. The Nominating Committee will finalize its slate of candidates in January 2010 and present the slate at NRCA's 123rd Annual Convention in February 2010. Deadline for nominations is Dec. 11; Eileen Maloney (emaloney@nrca.net) has the forms.

Lastly, NRCA has introduced two new membership categories: rooftop photovoltaic manufacturers and utilities and rooftop photovoltaic service providers. The rooftop photovoltaic manufacturers and utilities category is designed for photovoltaic (PV) systems manufacturers and companies arranging for power purchase agreements that use rooftops to collect energy. The rooftop photovoltaic service providers category is designed for companies involved with rooftop PV systems, including inverter and controls manufacturers and integrators that have an interest in PV systems and could benefit from a closer relationship with the roofing industry.
