In many respects I have some problems with the public school system. Like any governmental entity, the schools are full of waste and inefficiency, the kind that would put private businesses like ours out of business, or bankrupt us personally. I recently attended a refreshing school field trip however that taught kids otherwise.

Any of you who have 5th graders may be familiar with the Young Ameritown program. At Young Ameritown, kids are taught the basic lessons of money management and capitalism. After a five week in-class curriculum, the students are taken to the Young Ameritown center in Cherry Creek. Situated on the 2nd floor of the Young Americans bank, a bank for those under 21 years old, is the Young Ameritown. The "town" has all the pieces of a working economy; a bank, university, retail and service businesses, stock brokerage along with a town hall and police department. During the classroom portion of the program the kids interview for the job they want with the companies' human resource department (parents) and two jobs, Judge and Police Chief, are elected positions. The kids may not get the job they want based on the interview or election (life lesson #1). Once they are "hired" managers, workers, and accountants are selected by the staff. One of the first orders of business is to conduct the first payroll and cash paychecks at the bank so that the economy can start. Much to some of the employee's dismay, all jobs don't pay the same (life lesson #2). As the day goes on the company accountants pay venders, collect sales revenue and keep track of the ever looming loan payment due to the bank at the of the day. The kids all have a list of basic necessities that they must purchase by the end of the day like stamps, groceries or an airline flight. Sometimes they are faced with unexpected expenses like a car breakdown or air conditioner repair (life lesson #3). At the end of the day the businesses are expected to make a profit and pay off their business loan, or face shutdown by the bank (life lesson #4).

In the end the students have a basic grasp of entrepreneurism and money management from a real world perspective. They have received pay for their hard work, paid bills and purchased products which they get to take home with them. As we watch our government try to spend its way out of recession, it is refreshing to see the true American values of working, saving and investing can still being taught.

Legislative Update

With the Colorado 2009 Legislative session scheduled to end on Wednesday, May 6th, there is still a lot to be done in the three remaining days. Here's a clip:

From the Senate:
SB09-281: The resurrected senate bill to change Pinnacol Assurance into a state run entity is still out there. After a confusing day in April that turned a NO vote into 'we didn't like that outcome, let's try it again', the bill has been amended and is back in the senate itself. This occurred under the rule that allows a request for 'immediate re-consideration' within 48 hours after a bill dies. As the bill sponsor (Shaffer- D, Boulder) is majority leader, his request was approved. Per Pinnacol's website, the amended bill includes provisions for performance and financial audits to be conducted by the state auditor and paid for by Pinnacol as well as an interim committee to study Pinnacol and make recommendations on future operations. The language for a committee to study the Colorado workers' compensation system itself has been removed. Pinnacol representatives believe this bill language lacks clarity, is redundant with current state law and that mechanically it cannot be implemented. I won't claim to understand the legislative procedure that allowed this killed bill to be brought back to life and I'll get more info for a wrap-up article next month - but in the meantime, the process now is that the Senate has to adopt the conference committee report as presented at the capitol today. Then it has to re-adopt the bill as amended by the report. This same procedure has to happen in the House. If both of these occur, it will move to the Governor for final approval. Interesting to me that the success of a company can bring such negative and demanding governmental scrutiny.

SB09-246: You may have heard already, but thankfully the Homeowner Protection Act, which would have allowed extended interest payments in construction defect lawsuits was defeated.

From the House:
HB09-1057:
The Parental Leave bill allowing non-supervisory employees to take unpaid leave to attend academic related activities related to the education of a child in grades K-12 has passed in both the House & Senate and awaits signature by the Governor. This applies to employers with at least 10 employees. Leave can be taken in 3 hour increments and is limited to 6 hours per month and 40 hours per academic year.

HB09-1149: With renewable energy a hot topic in this session, the bill requiring homebuilders to offer prospective buyers the option to have the new home include or be pre-wired for cost effective solar energy systems is pending the Governor's signature as well. Supporters note that this bill makes it easier to finance renewable energy with a home mortgage.

HB09-1310: The Employee Misclassification Bill has passed through both the House and Senate as of Friday, May 1st. While I am a big proponent of everybody following the same rules and being honest about the people who work for you, I will be interested to see how a new governmental study to review the scope of the problem actually pans out. The actual effectiveness of this bill, if signed, will also depend solely upon reports of misclassification being made by others. With much of the evidence in our industry being hearsay as opposed to hard factual documentation, call me skeptical but I'm not sold on this bill actually making any changes. We can always hope I guess!

HB09-1299, the National Popular Vote agreement and HB09-1273, the Colorado Guaranteed Health Care Act have both been laid over daily until May 7th, the day after the session is supposed to be over. This means they are both dead in the water.

While thoughts at the beginning of a session tend to be hopeful of passing positive business legislation, often times the successes end up being that we stood unified and defeated particularly onerous bills for the industry. I'm proud that once again, when the time came to speak out, you did. Your voices were heard related to Pinnacol Assurance, mandatory sick leave, construction defect interest and prompt pay reform. Thank you all for your help, your time, and your thoughtful commentary to our legislators this session as we continue in the job of advocating and educating with those under the gold dome.

Brad Moody joined Moody Insurance Agency in 1991, and was named President in November 2005. Mr. Moody oversees all operations of the Denver office in addition to remaining an active insurance broker servicing a large book of business.

Brad concentrates his business in risk management solutions for the construction and real estate development industries. He specializes in risk management consulting, allowing his clients to strengthen their safety environment, reduce losses, and improve their bottom line by managing insurance costs.

Currently a Certified Property & Casualty Underwriter (CPCU), Mr. Moody received his B.A. degree in business administration and finance from the University of Kansas and is currently active in CRA, AGC, and Vistage.

WSRCA Roofing Expo, MRCA Convention

Western States Roofing Contractors 35th Annual Convention & Trade Show

The Western States Roofing Contractors Association (WSRCA) will hold its 35th Annual Convention and Tradeshow in Reno, Nevada from June 14-17, 2009 at the Peppermill Resort & Casino.

The Western Roofing Expo highlights the best in what the roofing industry has to offer, and attracts attendees from all over the United States. The Association is expecting a great turnout to this Nevada hotspot, as attendance has skyrocketed over the past five years. With 300 booths on the tradeshow floor and over 160 exhibiting companies participating, the Western Roofing Expo 2009 promises to be the best regional roofing show in the country.

WSRCA President Chuck Chapman of Central Roofing Company in Glendale, Ariz., said the Western Roofing Expo represents WSRCA's commitment to promoting professionalism and excellence in the western roofing industry.

"Every year the show has more attendees than the previous year, and we know this is due to the outstanding work of the Board of Directors and WSRCA staff to make this show what it is today," Chapman said.

ITEMS TO NOTE . . . FROM ACROSS THE NATION

A quick summary of issues that just "won't go away". . .

The Employee Free Choice Act—or "card check" bill—was dealt a blow in April when Sens. Specter (R-Pa.) and Lincoln (D-Ark.) indicated they would not support the bill in its current form. Both, however, left wiggle room in their statements of opposition, and there remains a danger of attempts at passing a watered-down version of the bill. NRCA remains steadfastly opposed to the bill and its two most onerous provisions: eliminating secret elections for unionization and binding arbitration in the event parties can't agree to a new contract.

Immigration reform may now be back in play with the Obama administration opening the door to preliminary discussions. Meanwhile, challenges made by NRCA and others to imposing E-Verify rules on federal contractors and subcontractors continue, and the U.S. Citizenship and Immigration Service announced another postponement of the effective date of its proposed rule to June 30. This delay, presumably, is to allow the administration time to decide whether it will implement, modify or rescind the rule.

And the administration also has put forward ideas on the estate tax, or "death" tax, that include restoring a rate of up to 45 percent with an exemption of $3.5 million. Interestingly, the Senate recently voted 51-48 to set the tax rate at a maximum of 35 percent with a $5 million exemption, suggesting the administration might not get its way. Now is a great time to let your elected officials know how you feel about this issue and what effect the tax might have on your business.

Federal agencies have begun to issue plans for how they intend to spend the money they received as a result of the American Recovery and Reinvestment Act. A good resource for members is the Small Business Administration (SBA); SBA can help guide you through the steps necessary to do work with the federal government, among other things.

The National Roofing Legal Resource Center (NRLRC) will release two new documents this month. A Comprehensive Guide to Wage and Hour Regulations Affecting Roofing Contractors addresses regulations governing minimum wage, overtime and Fair Labor Standards Act regulations, among others. A Roofing Contractor's Guide to Construction Contracts discusses critical contract clauses, contract interpretation and dispute resolution. NRLRC members receive both free as a benefit of membership. Homeowners receive tax credits for asphalt shingles

The American Recovery and Reinvestment Act of 2009 offers homeowners a tax credit when they purchase reflective asphalt shingles. Homeowners can receive as much as a 30 percent tax credit on reflective shingles up to $1,500 through 2010.

To qualify for the rebate, the shingles must meet the U.S. Environmental Protection Agency's ENERGY STAR® requirements for initial and three-year solar reflectance. State and local agencies may offer additional incentives and rebates for installing energy-efficient roofing products. Visit North Carolina State University's Database of State Incentives for Renewables & Efficiency at www.dsireusa.org for offers in your state or local area.

The tax credit should be claimed on federal income-tax forms. Homeowners need to download and complete the Manufacturer's Certification document and keep it, along with all receipts or itemized bills from the contractor showing the amount spent on reflective shingles between Jan. 1, 2009, and Dec. 31, 2010. OSHA announces rulemaking regarding combustible dust

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) is employing a comprehensive rulemaking to address combustible dust.

U.S. Citizenship and Immigration Services announced April 16 that the effective date of the final rule that would require federal contractors and subcontractors to use the E-Verify program has been delayed until June 30.
